Five activists convicted of damaging a Barclays Bank branch in Burnley are set to learn whether their sentences will include a terrorism link, in a move legal experts describe as highly unusual.
The Burnley Protest and the Legal Twist
Brendon O'Hagan, 28, Amanda Kelly, 31, Hmeera Atiqnisar, 31, Mohammed Malik, 28, and Alma Yaniv, 70, were found guilty of causing 212,000 pounds in damage at a Barclays Bank in Burnley, Lancashire, in August 2024. The group targeted the bank over its investments in Elbit Systems, an Israeli defence firm.
At the time of their trial, Palestine Action had not been banned as a terrorist organisation, and neither the defendants nor the jury knew that terrorism charges might later be considered.
A Rare Use of Terrorism Laws
Following the verdicts, trial judge Philip Parry informed the defence he intended to examine whether the offence carried a 'terrorist connection', a step taken after a similar ruling in June involving activists at Elbit Systems' Filton site.
Raj Chada, a criminal lawyer at Hodge Jones & Allen, said the use of 'terrorist connection' laws in this way is 'very, very unusual' and appears aimed solely at Palestine Action activists.
Reactions and Wider Context
Huda Ammori, co-founder of Palestine Action, called the involvement of Robert Altham, the judge who will decide on the terrorism link, 'shocking', citing his 2018 environmental protester sentencing as 'manifestly excessive'.
Since Palestine Action was proscribed in July 2025, more than 3,500 people have been arrested for expressing support, many at Parliament Square sit-ins.
