A High Court judge has ordered Prince Harry, Elton John and five other claimants to pay $17.88 million in legal costs to Associated Newspapers, publisher of The Daily Mail, after dismissing their privacy lawsuits as unreasonable and built on speculative foundations.
Damaging Ruling Against High-Profile Claimants
Justice Matthew Nicklin rejected the privacy lawsuits brought by Prince Harry, Elton John and five others, dismissing allegations that The Daily Mail engaged in phone hacking and other unlawful activities. The judge ruled the claimants' case was conducted unreasonably, with serious allegations resting on speculative and inferential foundations.
Explaining his decision, Justice Nicklin said the cumulative effect of the matters took the case well outside the norm, and the conduct was unreasonable to a high degree. The ruling was delivered on Friday, following a hearing that took place in July.
Indemnity Basis and Financial Burden on Claimants
The interim payment of 9.54 million British pounds, equivalent to $17.88 million, was ordered on an indemnity basis, meaning the claimants must pay without the publisher needing to show costs were reasonable. Associated Newspapers incurred a legal bill of 34.5 million British pounds, while the claimants' insurance policy covered only 16 million pounds.
Associated's lawyer Antony White argued the claimants made egregious allegations without supporting evidence, which added to their costs. Nicholas Bacon, lawyer for the claimants, described the 34.5 million-pound bill as eye-watering and far exceeding an agreed budget.
Publisher Celebrates Victory Over Privacy Lawsuits
A spokesman for Associated Newspapers called the ruling another overwhelming victory for the Mail and its journalism. The judge also ordered an interim payment of 9.54 million British pounds towards the legal costs of Associated Newspapers, which publishes The Daily Mail and other titles.
A spokesman for Prince Harry did not immediately respond to a request for comment from Reuters. The court was told at a hearing in July that Associated had incurred a legal bill of 34.5 million British pounds, while Prince Harry and other claimants only had an insurance policy which covered 16 million pounds.
