Flawed Installation Undermined the Indictment
U.S. Attorney Jeanine Pirro's office acknowledged that it only learned of evidence pointing to a rushed and flawed installation process after Hearn had already been indicted by a grand jury. The filing stated that the government proceeded to indict Hearn before obtaining or evaluating the information necessary to establish a good-faith basis for the charge.
Hearn, a former U.S. Olympic canoeist, pleaded not guilty last month to felony destruction of property after Pirro's office accused him of forcefully and violently ripping up parts of the pool floor. His legal team argued that the court should not leave the defendant subject to the possibility of renewed prosecution.
Trump Criticizes Pirro's Decision
President Donald Trump publicly criticized Pirro's move to drop the case, saying she choked and folded like an umbrella. He continued to push allegations that vandals were responsible for cutting and tearing the pool lining, despite the government's acknowledgment of the flawed installation.
The case has drawn attention for its unusual circumstances, with the government admitting its own investigative shortcomings after the indictment was filed. The pending hearing will determine whether Hearn is fully cleared or remains vulnerable to future charges.
