An Iowa district judge on Wednesday dismissed President Donald Trump's lawsuit against The Des Moines Register and its former pollster, rejecting the claim that the newspaper's coverage of a 2024 poll violated state consumer fraud law.
Judge Rules in Favor of Free Speech Protections
Iowa District Judge Scott J. Beattie ruled that the suit sought to 'stretch both Iowa statutory and common law beyond their current bounds, turning speech that enjoys the highest category of First Amendment protection into a liability.'
After reviewing the arguments, the judge concluded the constitutional protection 'is too great and the reach is too far. The case must therefore be dismissed.' The ruling sided with pollster J. Ann Selzer and the newspaper.
Background on the Lawsuit and Poll Dispute
Trump filed the lawsuit in December 2024 against Selzer, The Des Moines Register, and its parent company Gannett Co., alleging the poll misrepresented the 2024 presidential race. U.S. Rep. Mariannette Miller-Meeks and former state Sen. Brad Zaun joined the suit.
The poll, conducted in the final days of October and released just before Election Day 2024, showed Kamala Harris capturing 47% of Iowa likely voters to Trump's 44%. Trump ultimately won 56% of the nearly 2 million Iowans who voted.
Defendants Argue Poll Coverage Is Protected Speech
Selzer and her co-defendants argued that courts have never considered polls or newspapers covering them to be commercial speech, even though they may be sold for a profit. They emphasized the coverage was constitutionally protected political speech.
They also disputed the consumer fraud claim, noting the poll and coverage were not connected to transactions between the companies and Trump, Miller-Meeks or Zaun. The case was supported by the free speech advocacy group Foundation for Individual Rights and Expression.
