Brussels and Budapest are examining whether allowing two temporary migration measures to expire could end the European Union's €1m-a-day penalty against Hungary, without requiring Prime Minister Péter Magyar to alter his border policy.
A Legal Loophole to Stop the Fine
Hungary has lost €910m since the European Court of Justice ruled in 2024 that Viktor Orbán's government failed to apply EU standards for asylum seekers. The two laws under scrutiny are the 'state of crisis due to mass migration', due to expire on 7 September, and a 2025 law requiring asylum seekers to register at a Hungarian embassy before applying in-country, set to lapse at year's end.
Prime Minister Péter Magyar said at a press conference on Thursday: 'It's a very difficult thing. It's something that tests lawyers. It might just be necessary for something to come into effect for one day, then we tick this off, the one million euro fine is abolished, and then the next day an equally strict, slightly differently functioning regulation comes into effect.' The move would not require Magyar to soften Hungary's migration policy, according to Euronews.
Brussels and Budapest Engage on the Issue
European Commission spokesperson Markus Lammert said: 'It's for Hungary and the court to see what can be done. What we can do from the Commission's side is engage closely with the Hungarian authorities on the matter.' Magyar also met European Council President António Costa on Wednesday, saying: 'We expect an early resolution of the suspension of the €1m-per-day fine imposed under the previous Hungarian government.'
Magyar also met European People's Party leader Manfred Weber and called for the fines to be reimbursed through the EU's next seven-year budget. Magyar added: 'I emphasised that, in light of what happened in Ceuta this summer, Hungary will continue to maintain the necessary legal environment and physical border closure to stem illegal migration.' Officials in budget talks say 'everything is possible' regarding additional resources for border protection.
Experts and MEPs Remain Skeptical
EU law expert Tamás Lattmann told Euronews: 'Amending the migration-related laws adopted in 2015–16 would have been an opportunity to avoid the fines.' He noted that the only way to cap the fines would have been for the government to declare alignment with EU standards when the Migration Pact entered into force, which did not happen. Magyar has rejected the application of the EU's Migration Pact in Hungary.
Dutch Green MEP Tineke Strik said: 'I find it quite shameless that Magyar wants reimbursement of fines for a violation of EU law that has not been resolved at all. Granting reimbursement of fines imposed by the court would also mean the EU itself undermining or discrediting its own judgments.' Magyar said Hungary would seek credit for the fines during new EU budget negotiations, though the EU is not prepared to label funding as reimbursement for past fines.
