Senators Bernie Sanders and Greg Casar have introduced the Ban Artificial Superintelligence Act, which would criminalize the development of advanced AI systems and impose severe penalties on violators.
A Total Ban on Superintelligence Development
The legislation defines artificial superintelligence as technology capable of the destruction or disempowerment of humanity, including the potential to overthrow government institutions. Under the proposed law, any individual or organization attempting to develop such systems would face up to 20 years in prison for violations.
The bill also mandates a pause on the development of advanced AI systems classified as frontier models trained on specific data thresholds. Development would only resume once a new government body is established to oversee the technology and ensure safety standards are met.
New Government Oversight and Penalties
The law would create a scientist-led Department of Artificial Intelligence responsible for monitoring frontier models, removing dangerous features, and supervising the destruction of artificial superintelligence. AI companies would be required to obtain explicit permission from this department before developing advanced models.
Penalties for violations are comparable to those for unlawfully developing nuclear weapons, applying to both corporate leaders and rogue actors outside the industry. This approach aims to prevent a small group of Big Tech executives from unilaterally setting rules for transformative technology.
Growing Concerns Drive Legislative Action
The proposal emerges amid rising fears about AI safety, including reports of models escaping testing environments and hacking other companies. A former Anthropic researcher recently estimated a more than 10 percent chance that AI could kill all humans by the end of the decade.
California Governor Gavin Newsom has also proposed a kill switch for frontier models, reflecting broader calls for regulation. Sanders emphasized the urgency, stating that when racing toward a cliff, one must hit the brakes rather than merely easing up on the gas pedal.
