U.S. District Court Judge Colm F. Connolly issued a divided decision on X's request for a preliminary injunction against Operation Bluebird, a Virginia-based startup seeking to launch a competing social network. The judge granted the injunction covering eight Twitter-related marks but denied it regarding the Tweet word mark and the bird logo, finding that X had likely abandoned those specific trademarks.
The ruling means that while X retains legal protection over the primary 'Twitter' name, the rival company is permitted to continue using the word 'Tweet' and the iconic bird symbol, which the court determined were no longer in active use by the social media giant.
Startup Rebrands and Opens Registration
Following the court's decision, Operation Bluebird has rebranded its platform as Tweet.app and opened registration to the public, with the company charging users $20 to reserve their handle and join the network. The effort is led by founder Michael Peroff and Stephen Coates, a former Twitter trademark lawyer who now serves as the startup's president.
The platform attracted significant early interest, with more than 172,000 people requesting a handle before the site went live. The homepage explicitly states the company's goal is to reclaim trademarks that X relinquished when it rebranded from Twitter to X.
Case Continues to Determine Final Ownership
The court's preliminary ruling is not final, and the case will proceed to a full trial to determine whether X ultimately retains rights to any of the former Twitter trademarks. Judge Connolly noted that Bluebird is likely to succeed in proving that X discontinued the bona fide use of the Tweet mark and bird logo with no intention of resuming them.
Stephen Coates commented on the rebranding, stating that 'A tweet was never a corporation. It's one person saying something. That word survived three years of a company trying to replace it, because the public declined to stop using it.' The legal battle highlights the ongoing value of brand identity in the social media landscape.
