Federal regulators filed a lawsuit against Amazon on Monday, accusing the tech giant of secretly and systematically overcharging advertisers on its platform by manipulating its bidding process to pocket tens of billions of dollars.
The Core Allegations
A bipartisan coalition of 22 state attorneys general joined the Federal Trade Commission in filing the complaint in U.S. District Court in Washington, marking the third major federal lawsuit against Amazon. The suit alleges that Amazon manipulated its ad auctions to inflate costs for 1.2 million brands and sellers using its website and mobile app.
Amazon sells its advertising inventory through special auctions, a practice common in the industry. The government's complaint states that Amazon has deceived its customers and deprived them of the benefits of competition and fair and transparent dealing by rigging these auctions against its own advertisers.
Amazon's Defense
In its response filed on Monday, Amazon argued that the FTC misrepresented the reality of its ad auctions and cherry-picked findings to support its case. The company maintained that the quality of its advertising has improved over the years while the average cost-per-click remained flat when adjusted for inflation.
Amazon further contended that the lawsuit offers no evidence of harm to shoppers. The company's legal team suggested that the government's claims do not reflect the actual performance or value provided by its advertising platform to merchants and consumers alike.
A Pattern of Federal Action
This new lawsuit arrives just over a year after Amazon agreed to pay a historic $2.5 billion settlement to resolve a separate federal case regarding its Prime membership program, which the government alleged manipulated users into paying for hard-to-cancel subscriptions.
Amazon also faces another sweeping lawsuit by the FTC and 17 states that paints the company as a monopolist that suffocates competitors and raises costs for both sellers and shoppers, with that case slated to go to trial early next year.
