Treasurer Jim Chalmers has confirmed the government is prepared to accelerate a legislative fix to an unintended negative gearing loophole that penalises surviving partners when their co-owner dies, in exchange for Coalition backing on a $37 billion NDIS savings package.
The Ultimatum and the Deal
Opposition Leader Angus Taylor issued an ultimatum to the government, demanding an immediate resolution to what he described as a 'cruel' loophole that strips home owners of negative gearing eligibility if their partner dies or they separate due to family violence. The Coalition has made it clear that its support for the massive $37 billion NDIS savings plan is conditional on Labor addressing this issue without delay.
Treasurer Jim Chalmers responded by stating the government is willing to fast-track a fix to the unintended 'widow tax' created by its May tax changes, provided it secures the Coalition's support to save $37 billion in NDIS spending. He acknowledged that if the opposition's primary request is to pass the government's existing draft legislation more quickly, he is open to that discussion.
How the Loophole Emerged
The negative gearing changes announced in May introduced an unintended consequence for co-owners of investment properties. If one partner dies, the surviving partner who inherits their share loses the ability to negatively gear the property, as it now counts as a new ownership for tax purposes. Property investors remain eligible to claim rental losses only if the home was bought or settled before budget night.
Independent senator David Pocock identified the 'widow tax' as the negative gearing changes were passed through the Senate with the support of the Greens, calling for its abolition as a matter of urgency. He highlighted the case of a woman who left her partner due to family violence and is now unable to secure a bank loan to refinance her investment property, as it will no longer be eligible for negative gearing after July next year.
Government Response and Next Steps
The federal government has introduced draft legislation to fix the loophole as part of a second tranche of housing tax reforms, though that bill was not expected to be dealt with this fortnight. Mr Chalmers stated the government has already made it 'abundantly clear, crystal clear' that it is addressing the issues raised in the draft legislation and has consulted on them.
Mr Chalmers said he would not detail the negotiations with the opposition, noting they are primarily being held between the prime minister and opposition leader. The government is hoping to settle negotiations on its NDIS savings package so it can be passed this week, with the fast-tracked fix to the widow tax serving as a key condition for the Coalition's support.
